6. NCD ANNOUNCES A NEW REPORT ON UNIVERSAL DESIGN IN THE MARKETPLACE

In a new report, released October 28, 2004, the National Council on Disability (NCD) called on the designers and manufacturers of electronic and information technology (E&IT) to incorporate universal design processes when developing their E&IT products. The report demonstrates how designing with access in mind can significantly increase the size of targeted markets for E&IT.

ITTATC, in conjunction with Georgia Tech, has created and distributed a voter survey designed to measure voter satisfaction with the voting process and the accessibility of submitting a ballot electronically or otherwise.

2. ADA DOES NOT REQUIRE BUSINESS WEBSITES TO BE ACCESSIBLE

The Appellate Court for the Eleventh Circuit has upheld a Florida federal court’s determination that public websites are not subject to the Americans with Disabilities Act. Plaintiff, Access Now, raised a new argument on appeal that Defendant, Southwest Airlines, acts as a travel agent on its website, and therefore is a public accommodation subject to Title III of the ADA. The court rejected this argument for not having been made previously in the district court.

4. PHILADELPHIA INTENDS TO HAVE THE FIRST, BIG CITY FREE WIRELESS INTERNET NETWORK

City officials in Philadelphia are planning a 135 mile wireless "hotspot" at a cost $10 million. The network may be particularly useful to the residents of neighborhoods lacking high-speed Internet access, often low income neighborhoods and persons with disabilities in these neighborhoods.




5. NINE HONOREES RECEIVE NEW FREEDOM INITIATIVE AWARD

Secretary of Labor, Elaine L. Chao, has selected 5 businesses, 3 non-profit organizations, and an NFL player for the annual New Freedom Initiative Awards. The award "recognizes exemplary and innovative efforts to train, recruit, and hire people with disabilities . . .."




6. CELL PHONE RECYCLING ACT OF 2004

California is the first state to pass a law requiring the recycling of mobile phones. The Cell Phone Recycling Act of 2004 is a boon to protecting the environment from the toxic substances in phones as well as to a growing refurbishing market that will aid persons in low-income brackets afford mobile phones.

1. PARALYZED MAN SENDS E-MAIL BY THOUGHT

For many paralyzed persons, communicating and accessing the resources of the world require use of the muscle functionality of the eyes or tongue. Recently, surgeons implanted the BrainGate device into the motor cortex of a man with quadriplegia, permitting him to access computer information, such as checking email, using his thoughts.




2. STUDY USES MOBILE PHONES TO TRACK INDIVIDUALS WITH DEMENTIA

Mobile phones equipped with global positioning systems (GPS) are being used to track Londoners with dementia. New Technologies in Elder Care (NTEC) is conducting a study of the effectiveness of cell phones for this use. "The system can be used to track a dementia patient anywhere in the United Kingdom."




3. FOCUS GROUP STUDY PRESENTS TECHNOLOGY USE OF INDIVIDUALS WITH DISABILITIES

This comprehensive report provides the findings of a study using focus groups composed of individuals with disabilities, who share their daily experiences with the use of assistive and information technology.

In the context of independent living, the report notes the importance of the ability to use and have access to personal computers for bill paying, writing, conducting research, and communicating. For many participants, these activities required technology such as "screen reading software, . . . voice recognition programs, . . . text enhancer programs, . . . modified computer mouses, larger screens, and specialized keyboards." The report also provides a discussion of what people do when their technology breaks.

5. SETTING SITES ON SECTION 508

This news story addresses the issue of lack of contrast on websites and implications for persons with visual impairments. It finds that federal websites have made positive strides to correct this common form of inaccessibility under the mandate of Section 508, but that businesses, generally not subject to 508 (unless in receipt of federal funds), have not.

In a related news byte, GCN highlights the use of the Stanford University developed Daltonizing algorithm, which through the Vischeck website, "can pre-process print documents or post-process Web images right in the user’s computer, increasing the contrast for the most common red/green color visual deficit."

NCD’s report, Design for Inclusion: Creating a New Marketplace, analyzes six product lines from the telecommunications, software, consumer electronics, and digital services industries for accessibility and usability: ATM machines, cell phones, distance learning, personal digital assistants, televisions, and voice recognition software.

Sony is offering two models of its new LocationFree™ TV product. This is a portable, broadband, LCD television system and base station that transmits video to the "dedicated, wireless, touch panel screen."
